Terms of service - the basics

PLEASE READ THE FOLLOWING TERMS OF SERVICE BEFORE SUBMITTING YOUR ORDER TO www.edit-seven.com ("Edit Seven"). These Terms of Service, along with all rules and policies related to Edit Seven’s services as stated on Edit Seven’s website, including Edit Seven’s Privacy Policy (collectively, the "Agreement"), provide you with information about what you can expect from Edit Seven’s services and form a legal agreement between us. Your use of Edit Seven’s services constitutes your acceptance of this Agreement.

1. Images

For best results, please submit images that meet Edit Seven’s guidelines for resolution and file format. Edit Seven ensures that the edited images meet the quality our customers expect. Upon receipt, the returned image is deemed accepted unless, within seven (7) days, you contact Edit Seven through your account page detailing an error.

Edit Seven is committed to customer satisfaction and will work with you to correct any errors at its sole discretion, including re-performing services if necessary. This process repeats until the returned image is accepted. Edit Seven deletes all images approximately forty (40) days after their respective acceptance. Edit Seven is not responsible for the quality of returned images if the original submission does not meet its current guidelines.

2. Delivery

Edit Seven delivers images via a public web address (e.g., URL). While Edit Seven employs measures to make edited images accessible only to you, there are inherent security limitations in public web addresses for which Edit Seven is not liable. You can retrieve edited images by downloading them from the Edit Seven website, and additional retrieval options such as FTP or API may be available.

Edit Seven prioritises orders based on requested delivery dates and aims to meet them; however, delivery timeframes are not guaranteed.

3. Returns, refunds & cancelation policy

Edit Seven offers a 100% satisfaction guarantee. If you are dissatisfied with your images, we will work to meet your requirements. You may reject delivered images and return them for reprocessing free of charge if they do not meet your order specifications.

Refunds and account credits are evaluated on a case-by-case basis. If you need a refund or credit, contact our Customer Success team at info@Edit-Seven.com.

4. Payment

The price for services is set forth in Edit Seven’s price list in effect when your order is accepted. Edit Seven reserves the right to change its pricing without prior notice. All payments are made in Pounds Sterling. Edit Seven processes payment upon order submission and accepts the order upon verified payment.

Edit Seven may extend credit lines to large-volume, repeat customers on a case-by-case basis, invoicing them monthly. You are responsible for any applicable taxes, duties, or tariffs, excluding Edit Seven’s income tax. Free trials are limited to product images only and exclude images of pets, people, logos, or landscapes. Automated submissions for free trials will not be accepted.

5. Rights to use images

You are solely responsible for the images you submit. Edit Seven reserves the right to reject any image at its sole discretion. Submission does not imply a determination of your rights to use the image. By submitting an image, you represent and warrant that you have the legal authority to do so and that the image does not contain malicious software.

You grant Edit Seven a non-exclusive, worldwide, transferable, royalty-free, sub licensable, perpetual, irrevocable license under all intellectual property rights to use, modify, and distribute the image as necessary to perform the requested services. You agree to indemnify and hold harmless Edit Seven and its affiliates from any claims or liabilities arising from your breach of this Agreement.

6. Disclaimer of warranties

EXCEPT FOR THE PROCEDURE SET FORTH IN SECTION 1 (“IMAGES”), THE SERVICES ARE PROVIDED “AS IS.” Edit Seven makes no warranties, express or implied, regarding its services. All implied warranties, including those of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement, are expressly disclaimed. Some jurisdictions do not allow the exclusion of implied warranties, so these limitations may not apply to you.

7. Limitation of liability

Edit Seven is not liable for any special, incidental, consequential, indirect, punitive, or exemplary damages, including lost profits, revenue, business, or goodwill. Edit Seven’s total liability to you is limited to the total payments made for the relevant image. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so these exclusions may not apply to you.

8. Basis of bargain

Edit Seven has set its pricing in reliance on the limitations of liability and disclaimers stated herein, which form an essential basis of the agreement between the parties. These limitations and exclusions shall survive even if found to have failed their essential purpose.

9. Term

This Agreement is effective from the date you submit an image to Edit Seven until the date the returned image is accepted. Edit Seven may terminate this Agreement at any time, refunding fees for unedited images at its discretion. Sections 3-9 and any other provisions by their nature shall survive termination.

10. General provisions

This Agreement applies only to you and cannot be transferred. It is binding upon Edit Seven’s successors and assigns and is governed by the laws of the United Kingdom. Any disputes will be resolved through arbitration. This Agreement is in English, and its provisions are severable if any part is found unenforceable.

Edit Seven is not liable for failure to perform due to acts of God, natural disasters, labor strikes, government actions, energy crises, war, or interruptions beyond its control. Edit Seven may amend this Agreement at any time, with the terms in effect at the time of submission governing each order.

11. Security

Edit Seven provides a secure transaction environment, using encryption and established techniques to ensure data integrity. Online communications are encrypted, and additional protection is provided by your card issuer to prevent fraudulent use.
